Terms and Conditions

This is a draft prepared to describe how eOpinion actually works. It has not been reviewed by a solicitor. Please have it checked before relying on it.

1. Who these terms are with

eOpinion is operated by Hutch Media Group Ltd ("we", "us"), a company registered in England and Wales, of 160 Kemp House, City Road, London, EC1V 2NX. These terms apply when you sign up an organisation to use eOpinion.

2. The service

eOpinion provides a branded page for your school, college or university where pupils, parents and staff can submit suggestions and feedback, and a dashboard for your administrators to review and respond to them internally. Suggestions are not published publicly by eOpinion.

3. Subscriptions and billing

Subscriptions are billed monthly or annually in advance, in GBP or USD, through Stripe. Additional schools added to the same account are billed at half the base price. You can cancel at any time; your access continues until the end of the billing period already paid for. We do not offer refunds for partial periods, except where required by law.

4. Your responsibilities

You are responsible for the accuracy of the information you provide when signing up, for keeping your admin login secure, and for how your school acts on the suggestions it receives, including any safeguarding, welfare or complaints obligations that already apply to your organisation. eOpinion is a communication channel, not a substitute for your school's existing safeguarding or complaints procedures.

5. Acceptable use

You must not use eOpinion to collect information unlawfully, to harass or discriminate against anyone, or in any way that breaches applicable data protection law, including in respect of pupils under 18. We may suspend or terminate an account that we reasonably believe is being used this way.

6. Content you submit

Suggestions submitted through your organisation's page belong to you as the receiving organisation. eOpinion does not claim ownership of submission content and only processes it to deliver the service.

7. Availability and changes

We aim to keep eOpinion available at all times but cannot guarantee uninterrupted service. We may update or improve the service from time to time. If we make a change that materially reduces its functionality, we will let account admins know in advance where reasonably possible.

8. Liability

Nothing in these terms limits liability for death, personal injury, or fraud. Beyond that, our liability to you for any claim arising from your use of eOpinion is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential losses.

9. Ending an account

You can cancel your subscription at any time from your account. We may suspend or end an account for non-payment or breach of these terms, with notice where reasonably possible.

10. Governing law

These terms are governed by the law of England and Wales, and any dispute will be handled by the courts of England and Wales.
